Terms and Conditions

1. Your contract

Andalucian Villas Rentals acts as a rental agent for the owner of la Duna Alta. Each contract is between the owner of the property and the applicant. Andalucian Villa Rentals is part of Pertle Limited. registered office; Wincham House, Greenfield Farm Trading Estate, Congleton, Cheshire, CW12 4TR. Company registration number 08123070.

2.How to make a reservation

If you agree to these terms and conditions and also indicate this in your application, we can accept your booking. The person submitting the booking form does so on behalf of all members of the party and jointly binds them to these terms and conditions.

3.Payment method

You can pay by credit card, debit card or bank transfer. If you pay by bank transfer, we will hold your selected property for seven days while you arrange payment. If you are paying in a currency other than GB Pounds or Euros, please use our credit or debit card facilities. All card transactions are billed in pounds sterling and converted into your local currency at the prevailing rate by the card issuer.

4. First payment

At the time of your booking you will be asked to pay an initial non-refundable deposit of 25% of the total cost of the accommodation. This payment is your only obligation until 6 weeks before your arrival.

5. Balance Payment

The balance of the travel sum must be paid no later than 6 weeks before arrival. Please ensure payment is made within that time or we reserve the right to treat your booking as cancelled, in which case you may be liable to pay us the cancellation charges set out below. If you arrange your holiday within 6 weeks of departure, full payment must be made with your booking.

6.If you cancel your booking

If you wish to cancel your booking you must do so by sending written confirmation. In the event of a cancellation and to offset the cost of processing your booking and any losses that may result from not being able to re-let the holiday period, the following cancellation charges will apply.

Cancellation refunds are according to the following time scale

Up to six weeks                                    Loss of   the deposit

Four to six weeks                        50% of the total rent

Two to four weeks                    75% of the total rent

Less than two weeks            100% of the total rent


7. Insurance Requirements

Holiday and travel insurance, including cancellation cover, is essential for your own protection and we strongly recommend that you and all members of your party are properly insured.

8. Deposit

We have two ways to collect a security deposit. For UK bookings there is a mandatory accidental damage fee of £8GBp per person per booking. This covers accidental damage that may occur to your villa during your holiday and it will cover you up to a value of £150GBp. Negligent or intentional conduct does not fall under this charge. If this happens, you will be asked to cover the cost of this damage locally. This only applies to standard bookings. We require an additional deposit if you rent a property to hold an event. For all other guests there is a refundable cash deposit payable on arrival, and will be refunded on check out, subject to a final check by our staff.

9. Number of persons

At no time are any persons allowed to occupy the property other than those stated on the booking form, except with prior written consent. Under no circumstances will the advertised occupancy rate be exceeded, with the exception of infants under two years of age. Property owners or their agents reserve the right to refuse entry if this condition is not adhered to.

10.Problems with the villa

If you have a problem during your holiday, notify the local representative immediately who will try to resolve the matter. If you fail to do so, we cannot accept responsibility as we have not had the opportunity to investigate and rectify the problem. While we will make every effort to resolve issues quickly, a reasonable amount of time should be allowed for repairs by outside contractors. In the unlikely event that a problem is not satisfactorily resolved during your stay, we require written notice within 14 days of the completion of your holiday. Please note that we do not accept liability for the periodic failure of public services or utilities such as water or electricity over which we have no control, nor of sewage, plumbing or mechanical equipment in villas, but we will do our utmost to make prompt repairs. arrange where possible.

11. Check-in and check-out times

Our villa is available from 4 pm on the day of arrival and must be vacated by 10 am on the day of departure. The maid, gardener and pool maintenance need this time to properly prepare the accommodation for the arriving guests. We will try to accommodate early arrivals and late departures where possible, but it's not always possible, please ask and we'll see what we can do.

12. Change and unavailability of accommodation

In rare cases it may be unavoidable that we have to change your chosen villa due to circumstances beyond ours or the owners' control. We will notify you of this and offer you either; alternative accommodation of comparable or superior standard or a refund if nothing else is suitable or discuss other options. No further claim against the owner or rental agent for any damages suffered will be considered.

13. Liability

Andalucian Villa Rentals accepts no liability for any act or omission on the part of the owners or any other person not in their service or control nor for any accident, damage, loss, injury or expense either to person or property which the tenants may suffer as a result of or in any way related to the rental. Also, the owner and rental agent accept no liability for loss of or damage to tenants' property while on the owners' property.

14. Proprietary Standards

We have made every effort to select and inspect all properties we advertise and we strive to maintain high standards. Inevitably, items break down or require maintenance. Therefore, please be aware that you may encounter maintenance staff and gardeners during your stay. Please also bear in mind that these are people's homes - please leave the villa in a reasonably clean and tidy condition and remove all rubbish at the end of your stay. We reserve the right to charge for additional cleaning, including the BBQ and rubbish removal if required.

15. On arrival

You will be met and taken to your holiday home. On arrival, familiarize yourself with the layout of the property and identify any hazards e.g. unexpected stairs, slippery surfaces, pool depths etc. Please also read the safety information in the welcome book. You are expected to provide us with all relevant identity information we need to provide the authorities with your stay.

16. Noise

La Duna Alta is located in the “campo” (outside the built-up area) and as such you may hear goats and sheep. Please note that noise and noise should be kept to a reasonable level, especially after 11pm. The likelihood of construction work being carried out in close proximity to the villa is slim but may occur without prior warning, this is understandably beyond our control: we will inform you if we become aware of such works. We also ask you to take into account the neighbors who may not be on holiday.

17. Safes

There is no safe in La Duna Alta.

18. Pool heating

The pool heating is not switched on in the periods May to June .

19. Air conditioning

Full air conditioning means all bedrooms and living areas are partially air conditioned. We do not accept any responsibility for the failure of these units under any circumstances, although we will always try to rectify the situation as quickly as possible. We expect that when you are not in the property the air conditioning will be turned off. 20. PetsWe regret that pets are not allowed in any of our accommodations.

20. Pets

We are sorry that pets are not allowed in any of our properties.

21. Local plants and animals

You will stay in a country with a diverse range of plants and local wildlife. We make every effort to ensure that these do not detract from the enjoyment of your holiday, but there are times when this cannot be avoided. We ask that you take care in the gardens and around the pool as there are plants with sharp points and insects, reptiles and other native species that see the pool as a convenient source of water.

22. Included in the costs

For stays of up to 10 nights, cleaning service is only on the day of arrival and day of departure. All villas have washing machines.An additional cleaning service can be arranged to suit your needs for an extra charge.Included:All towels including pool towels.Pool and garden maintenance.Fair use of water and electricity.All local and other taxes.Assisted by our local representative. For longer stays of four weeks or more, cleaning, laundry and utility bills are arranged on an individual basis.

23. Data Protection

By submitting one of our forms, you can rest assured that we will only answer your question. You do not subscribe to a mailing list and we will not pass your details on to anyone. We take your privacy seriously.

24. Applicable Law and Jurisdiction The validity, construction and performance of this Agreement shall be governed by Spanish law. The applicants and tenants submit to the exclusive jurisdiction of the Spanish courts.
